Данная статья будет полезна Вам тем, что в ней изложены ключевые правила толкования, применяемые в праве международной купли-продажи товаров, которые также равно применимы к договорам морского страхования. Перевод статьи был осуществлен моим коллегой и знакомым Геннадием Логиновым.

    Лорд Мансфилд о принципе наивысшей добросовестности

    «(Договор) страхования является договором, основанным на спекуляции. Особые факты, на которых случайная вероятность должна быть измерена, лежит в основном в знании страхователя; страховщик доверяет представлению фактов с его стороны и действует с уверенностью, что страхователь не скрыл никакого обстоятельства для того, чтобы ввести в заблуждение страховщика и убедить в том, что обстоятельства не существует и понудить его измерить риск, как будто его не существовало. Сокрытие такого обстоятельства является мошенничеством, и поэтому полис ничтожен.  Даже если сокрытие происходит из-за ошибки без мошеннического умысла, страховщик по-прежнему является обманутым и полис является ничтожным, потому что действительный риск отличается от понимаемого риска во время заключения договора.     The true scope of inherent vice - The Cendor MOPU

    The marine market will welcome this month’s important decision of the Supreme Court in  The Cendor MOPU 1 , which has unanimously confirmed that the inherent vice defence is limited to situations where the loss has been proximately caused by something internal to the insured subject matter and not as a consequence of the operation of some external fortuity. The Court very helpfully clarified the complex and at times difficult relationship between the insured risk of perils of the seas and the excluded peril of inherent vice, when it comes to establishing a proximate cause of a loss. As a result, the market should now see fewer coverage disputes on inherent vice issues; and although some difficulties may still remain those disputes which do arise should now be easier to resolve.
